N.Padmanabha Rao along with three others, residents of Hyderabd filed a PIL on section 8 in High Court, demanding scrapping of it as it gives Governor super powers on Hyderabad law and order.
Court after hearing the petition said one cannot question constitutional authority of section in AP state reorganisation act through a PIL and asked the petitioner to withdraw it. When petitioner’s advocate requested permission to submit a writ, it agreed for the same.overnment can use it when the need arises through Governor of two states.
