Now, Triple talaq is non-bailable offense

In a major relief to the victims of triple talak and Muslims rights activists, the Union Cabinet on Wednesday approved an ordinance making the islamic divorce a serious crime and a punishable offense in India.

Minister for Law and Justice Ravi Shankar Prasad said the government had to take ordinance route as it failed to pass it through both the houses of parliament. According to the proposed law, the crime is a non-bailable offense and accused can approach a magistrate even before trail to seek bail. So bail cannot be granted by the police at the police station. The police can also lodge FIR if approached by the victim (wife) relatives or kin.

Although the bill to criminalize talaq-e-biddat was passed by the Lok Sabha in the winter session of parliament in August, the bill got stuck in Rajya Sabha with the stiff opposition from the members.

Subsequently, the government approved three amendments to the ‘Muslim Women Protection of Rights on Marriage Bill’ in August. Now the ordinance move from the government is viewed as a big win for the women rights activists in Muslim community.
